Fairfax Man Charged With Reckless Driving at 110mph Found Not Guilty At Trial

Fairfax Reckless Driving attorney Jonathan Oates fought and beat a charge that his client was driving 110mph in a 55mph zone, two times the legal limit.  In Fairfax, a client found guilty of driving at speeds over 100mph will generally receive jail time.  With a goal of avoiding jail time for his client, Oates challenged the case at trial.

Oates challenged the officer during cross-examination, uncovering serious uncertainty about whether the radar calibrations the officer presented at trial were correct. Oates’ questions raised a major problem about whether the officer’s radar calibrations presented in court matched the radar used to clock his client at 110mph.

Without being able to overcome these doubts about the officer’s calibrations, the judge ruled in Oates’ favor, acquitting his client of reckless driving at the extreme speed of 110mph.  Oates’ client walked out of court a free man, avoiding any license suspension and points, and saving himself from certain jail time.
