Defining Strong-Arm Robbery
Strong-arm robbery is a form of theft where the accused either causes physical injury or threatens to cause injury to another person. The injury or threat does not need to be severe for it to qualify as strong-arm robbery. Unlike other types of robbery, strong-arm robbery usually does not involve using weapons.
For instance, if someone punches another person and takes their money without causing serious harm, it’s considered strong-arm robbery. However, If the individual threatens to kill the victim if they don’t hand over the money, the charge could be elevated due to the serious nature of the threat, resulting in harsher penalties.
Although strong-arm robbery is considered less severe than robbery involving aggravated threats or violence, it still carries a penalty of up to ten years in state prison upon conviction.
Strong-Arm Robbery Defenses
Several defenses are available to fight strong-arm robbery charges, one of the most common being innocence. The prosecution must prove beyond a reasonable doubt that the accused committed the crime. It is a high standard; a skilled attorney can challenge the evidence, creating doubt and demonstrating the accused’s innocence.
Voluntary intoxication, where the accused willingly consumed alcohol or drugs, is generally not an acceptable defense in Virginia. However, involuntary intoxication—such as being unknowingly drugged—can serve as a valid defense.
Another defense is duress, which occurs when someone is forced to commit a crime under the threat of harm or death. For example, suppose a person was coerced into committing robbery because their life or the life of someone they care about was in danger. In that case, this can be used as a defense.
