Running from the Cops in Maryland

In Maryland, it’s illegal for a driver to disobey a police officer’s visible or audible signal to stop. All that is required is for the officer to be in uniform OR for the officer to be in a marked police vehicle. If an officer orders the driver to stop, the driver must obey immediately. Willfully failing to stop, fleeing on foot, or attempting to escape is considered “eluding” under Maryland Transportation Article § 21-904.

Eluding can occur by: continuing to drive after lights or sirens are activated, attempting to flee once stopped, or abandoning a vehicle and running from the scene. Regardless of the method, Maryland law treats this offense seriously, as it endangers both law enforcement and the public.

Penalties for Eluding in Maryland

The penalties for eluding depend on the circumstances. Aggravating factors include: committing a crime of violence and then fleeing, causing another person to be injured, and causing another person to be killed.

Basic Eluding:
- First offense: Up to 1 year in jail and/or a $1,000 fine.
- Second or additional offense: Up to 2 years in jail and/or a $1,000 fine.
Eluding Causing Bodily Injury: Up to 3 years in jail and/or a $5,000 fine.
Eluding Causing Death: Up to 10 years in jail and/or a $5,000 fine.
Eluding During a Crime of Violence: If the driver flees police while being pursued for a crime of violence (as defined in Criminal Law § 14-101) and is later convicted of that crime, penalties may include up to 3 years in jail and/or a $5,000 fine.

A conviction for eluding also adds 12 points to your Maryland driving record under Maryland Transportation Article §16–402(41) – enough to trigger an automatic license suspension or revocation by the Maryland Motor Vehicle Administration (MVA).
