Esteban Gergely and his whole team are the best in the game hands down. His knowledge of the law, dedication to his clients and passion to win are simply unmatched. His staff are all super friendly, quick and thorough. Kelly was amazing through the whole process, the communication was above and beyond. Glenda is also someone I’ve worked with and she was nothing but pleasant as well. This team will give you a sense of confront regardless on the situation. When i first approached Esteban i was a mess but his first words were “relax, go on about your life as you normally would, leave the stresses of the case up to me, i got you” and he delivered. Not only did i have peace of mind the whole time but even if we hit any obstacles he overcame each one. Hired him on multiple occasions and will continue to do so if ever needed.Posted on Google![]()

A shoplifting charge in Washington, DC might seem minor, but it is a real criminal offense with real consequences. Depending on the value of the merchandise involved and your prior record, shoplifting can be charged as a misdemeanor or a felony, and even a misdemeanor conviction can show up on background checks, affect employment, and follow you for years.
What many people do not realize is that DC has a dedicated shoplifting statute with its own rules, and prosecutors have more than one way to charge the same conduct. If you have any prior theft convictions on your record, the stakes are significantly higher than you might expect. An experienced DC shoplifting lawyer can evaluate your situation, identify your options, and work to achieve a resolution that protects your record and your future.

How Shoplifting Is Charged in Washington, DC
DC has two separate paths prosecutors can use to charge shoplifting, and understanding the difference matters.
Shoplifting Statute: D.C. Code § 22-3213
DC has its own shoplifting statute separate from the general theft law. Under D.C. Code § 22-3213, shoplifting occurs when a person, without authority, willfully takes possession of any goods, wares, or merchandise offered for sale with the intent to convert them without paying, or conceals or takes possession of those items, or alters or removes a price tag with the intent to purchase the item at less than its actual price.
A critical feature of § 22-3213 is that you do not need to leave the store for the offense to be complete. Concealing merchandise inside the store, switching price tags, or placing items in a bag while still on the premises is sufficient to support a shoplifting charge. Loss prevention officers are trained to use this statute to their advantage.
The penalties under the dedicated shoplifting statute are lower than general theft: a maximum of 90 days in jail and a fine of up to $500.
General Theft Charges: D.C. Code § 22-3211
In practice, most shoplifting cases in DC are charged under the general theft statutes rather than the dedicated shoplifting provision. The degree of the offense depends on the value of the merchandise:
- Less than $1,000: Second-degree theft, a misdemeanor carrying up to 180 days in jail and a fine of up to $1,000
- $1,000 or more: First-degree theft, a felony carrying up to ten years in prison
Prosecutors have discretion over which statute to use, and they frequently opt for the general theft charge because the penalties are higher. Your attorney will evaluate which charge applies and what that means for your defense strategy.
The Repeat Offender Enhancement
This is where a shoplifting charge can become far more serious than most people expect. Under D.C. Code § 22-3212(c), any defendant with two or more prior theft convictions can be charged with felony theft regardless of the value of the property involved. That means a $20 item can result in a felony charge if you have two prior theft convictions on your record, with a mandatory minimum of one year in prison and a maximum of 15 years.
This enhancement applies broadly and is used regularly by DC prosecutors. The reality is that many people charged with shoplifting have prior theft-related matters on their record, sometimes from years ago, sometimes from other jurisdictions. If that applies to your situation, you are not facing a minor misdemeanor. You are facing a felony with a mandatory minimum, and you need an experienced attorney immediately.
The Shopkeeper’s Privilege in DC
DC law recognizes what is commonly known as the shopkeeper’s privilege: the right of a store owner or employee to detain a person they reasonably believe has shoplifted, for a reasonable period of time and in a reasonable manner, until law enforcement arrives. This means that if a loss prevention officer stops you inside or just outside a store, that detention may be legally justified even before police are involved.
However, the shopkeeper’s privilege has limits. The detention must be reasonable in duration and manner. Excessive force, prolonged detention, or conduct that goes beyond what is necessary to hold someone for police can expose the retailer to civil liability and may affect the circumstances of your arrest. Your attorney will review the details of how you were stopped and detained as part of building your defense.
What the Government Must Prove
To convict you of shoplifting under either statute, the prosecution must establish beyond a reasonable doubt:
- That you obtained, concealed, or attempted to take merchandise belonging to the retailer
- That you did so without authorization
- That you acted intentionally, with the purpose of depriving the retailer of the property or its value
Intent is a key element. If you did not intend to steal, that lack of intent is a defense regardless of what the loss prevention footage shows.
Potential Defenses to Shoplifting Charges in DC
Lack of Intent
Shoplifting requires intentional conduct. Absent-mindedness, confusion at self-checkout, or a genuine mistake does not constitute theft. If there is evidence that your failure to pay was not willful, that is a powerful defense.
Mistaken Identity
Large retail stores rely heavily on loss prevention officers and surveillance footage to identify shoplifters. Loss prevention personnel are not infallible, and surveillance footage does not always clearly identify individuals. If the identification of you as the person who committed the theft is not conclusive, your attorney can challenge it.
Value Dispute
The value assigned to merchandise determines whether you face a misdemeanor or a felony under the general theft statute. In cases close to the $1,000 threshold, your attorney can challenge the government’s valuation of the items involved.
Diversion
For first-time offenders, DC often offers diversion options that allow a shoplifting charge to be resolved without a conviction. Successfully completing the conditions of a diversion agreement, typically community service, a class, or restitution, results in the charge being dismissed. An attorney can identify whether you qualify and negotiate the most favorable terms.
Civil Demand Letters from Retailers
If you have been charged with shoplifting in DC, you may also receive a civil demand letter from the retailer’s attorney demanding payment of a fixed amount. These letters are separate from your criminal case and do not affect your criminal charges. Before responding to or paying any civil demand, speak with your attorney about how doing so might affect your criminal defense.
Consequences Beyond the Courtroom
Even a misdemeanor shoplifting conviction carries real-world consequences:
- It appears on criminal background checks conducted by employers and landlords
- It can affect professional licensing in fields that require background checks
- Repeat offenses can result in the felony enhancement under § 22-3212(c), dramatically increasing your exposure
- Non-citizens can face immigration consequences even for misdemeanor theft convictions

Frequently Asked Questions
Is shoplifting a felony or a misdemeanor in Washington, DC?
It depends on the value of the merchandise. Shoplifting involving property worth less than $1,000 is a misdemeanor. If the value is $1,000 or more, the charge is a felony punishable by up to 10 years in prison. Even for misdemeanor charges, having an attorney can make a significant difference in the outcome.
Can a shoplifting charge be expunged from my record in DC?
DC has expungement provisions that may apply in certain circumstances, particularly for first-time offenders whose cases were resolved through diversion or resulted in acquittal. An attorney can advise you on whether expungement may be available based on the outcome of your case.
What if I paid for some items but forgot to pay for others?
Accidental or inadvertent failure to pay is a defense to shoplifting. The government must prove intentional theft. If there is evidence that your failure to pay was a genuine mistake, for example, you paid for most of a large cart of items but missed one at the bottom, that context matters and should be presented to your attorney.
Do I need a lawyer for a misdemeanor shoplifting charge?
Yes. Even a misdemeanor shoplifting charge can result in a criminal conviction, a fine, and potential jail time. More importantly, a conviction will appear on background checks and can affect employment, housing, and professional opportunities. An attorney can often secure a far better outcome than you would achieve on your own.
