Can you get a security clearance with a DUI? A DUI arrest or conviction doesn’t automatically mean you will be denied a security clearance. Still, it will be taken into account during the application review. To qualify for a security clearance, you must not have a drug addiction or a felony conviction. If the DUI was a felony or if there are signs of an alcohol abuse problem, it could negatively affect your chances of getting approved.
What Is a Security Clearance?
A security clearance permits people to access classified information as part of their work. It is often required for military personnel, government employees, and contractors working with the government.
There are three levels of security clearances:
Confidential Clearance: This is the lowest level of security clearance.
Secret Clearance: This is the next level up.
Top-Secret Clearance: This is the highest level and allows access to the most sensitive classified information.
Applying for and Renewing a Security Clearance
To get a security clearance, a person must complete an application. After applying, a background check will be conducted. Once the background check is finished, the application will be approved or rejected. This entire process can take up to six months.
Security clearances also need to be renewed periodically, with different renewal periods for each level:
- Top Secret: every five years
- Secret Clearance: every ten years
- Confidential Clearance: every 15 years
How a DUI Affects the Renewal of a Security Clearance
Similar to applying for a security clearance, a DUI arrest or conviction does not automatically lead to a denial of renewal. During the review process, the government agency will consider several factors, including the individual’s background, any other criminal arrests or convictions, the time since the last DUI conviction, and any other relevant circumstances.
During this review, the individual will have the chance to present their case and defend themselves. If their security clearance is not renewed, they can also appeal the decision.
